OPTIMUM SOLUTION LLC is the data controller responsible for personal information collected through the Site and through telephone, email, and web-form contact with us. Questions about this Privacy Policy should be directed to the contact details above.
2. Scope of This Policy
This Privacy Policy explains what personal information we collect, why we collect it, how we use and share it, how long we keep it, and the choices and rights available to you. It applies to information collected through the Site, through our published telephone line, through email correspondence, and through any enquiry, quote-request, or callback form we operate.
This policy does not apply to third-party websites, products, or services that we do not own or control, even where we link to them. It also does not apply to information you provide directly to a third-party software or hardware manufacturer.
3. Information We Collect
3.1 Information you provide to us directly
- Identity and contact details: your name, business name, job title, email address, postal address, and telephone number.
- Service enquiry details: a description of the technical issue, service, or configuration assistance you are requesting; the make, model, operating system, and software version of the equipment concerned; error messages, logs, or screenshots you choose to send us; and the outcome you are seeking.
- Engagement and billing records: the scope of work agreed, quotes issued, invoices, work notes, and correspondence relating to your engagement.
- Payment details: where you purchase a service, payment card and billing information is collected and processed by our third-party payment processor. We do not store full payment card numbers on our own systems.
- Recruitment information: where you use an application form on the Site, the information contained in your application and any attachments you submit.
- Any other information you voluntarily choose to send us by phone, email, or form.
3.2 Information collected automatically
- Device and connection data: IP address, browser type and version, operating system, device type, screen resolution, and language settings.
- Usage data: pages viewed, time spent on pages, referring URL, exit pages, clicks, scroll depth, and the search terms or advertisements that brought you to the Site.
- Cookie and identifier data: cookies, pixels, tags, and similar technologies as described in Section 7.
3.3 Telephone call information
When you telephone the number published on this Site, we collect your telephone number (including where it is transmitted by caller ID), the date, time, and duration of the call, the number or advertisement that routed the call, and notes taken by our personnel about your enquiry.
Where a call is monitored or recorded, we will inform you at the beginning of the call and will proceed only with the consent of all parties on the line, as required by Maryland law and the laws of other applicable jurisdictions. If you do not consent to recording, you may say so and we will either disable recording or continue the call without a recording. Declining to be recorded does not affect the service you receive. Further detail is set out in Section 8.
3.4 Information we do not want and do not ask for
We do not ask for, and you should never provide, your full account passwords, banking login credentials, one-time passcodes or verification codes, complete payment card numbers by email or web form, or your Social Security number. We do not require access to your financial accounts in order to provide technical services. If anyone contacts you claiming to represent us and asks for any of these, treat the contact as fraudulent and report it to us at support@geniusanswer.online.
We do not knowingly collect special category or sensitive personal information, and we ask that you do not send it to us. If you send us files, logs, or remote access to a device, that material may incidentally contain personal information belonging to you or to others; we will use it only to perform the service requested and will delete or return it in accordance with Section 10.
4. How We Use Your Information
We use personal information for the following purposes:
- To respond to your enquiry, answer your questions, and provide a quotation.
- To provide, perform, document, and support the services you engage us for.
- To process payments, issue invoices and receipts, and maintain accounting records.
- To communicate with you about an active engagement, including scheduling, status updates, and completion summaries.
- To provide customer service, handle complaints, and resolve disputes.
- To maintain the security and integrity of our systems, detect and prevent fraud, and protect our legal rights.
- To operate, maintain, analyse, and improve the Site and our service offering.
- To measure the effectiveness of our advertising, including attributing enquiries and conversions to the advertisement or search term that generated them.
- To send you service-related or marketing communications where you have consented or where we are otherwise permitted to do so, subject to your right to opt out at any time.
- To comply with applicable law, tax and record-keeping obligations, and lawful requests from public authorities.
We do not use your personal information to make automated decisions that produce legal or similarly significant effects about you.
5. Legal Bases for Processing
Where the General Data Protection Regulation, the UK GDPR, or a comparable framework applies to our processing, we rely on the following legal bases:
- Performance of a contract, or steps taken at your request prior to entering a contract, to provide quotations and deliver services.
- Legitimate interests, to operate and secure our business, understand how the Site is used, prevent fraud, and market our services proportionately.
- Consent, for non-essential cookies, call recording, and marketing communications where consent is required. You may withdraw consent at any time without affecting the lawfulness of processing carried out before withdrawal.
- Compliance with a legal obligation, for tax, accounting, and regulatory record-keeping.
6. How We Share Information
We do not sell your personal information, and we do not share it for cross-context behavioural advertising in exchange for money or other valuable consideration. We do not rent, trade, or otherwise transfer your contact details to unrelated third parties for their own marketing.
We share personal information only in the following circumstances:
- Service providers and processors, who act on our instructions and are bound by contractual confidentiality and security obligations. These include our website host, email provider, customer relationship and ticketing tools, telephony and call-tracking provider, payment processor, analytics and advertising measurement providers, and professional advisers.
- Advertising and analytics platforms, in the form of cookie and identifier data used to measure advertising performance, as described in Section 7.
- Professional advisers, such as our accountants, auditors, insurers, and lawyers, where reasonably necessary.
- Legal and regulatory disclosure, where we are required to disclose information by law, court order, subpoena, or a lawful request from a public authority, or where disclosure is necessary to establish, exercise, or defend legal claims.
- Business transfer, in connection with a merger, acquisition, financing, reorganisation, or sale of assets, in which case we will require the recipient to honour this Privacy Policy or notify you of any material change.
- With your consent or at your direction, including where you ask us to liaise with a manufacturer, vendor, or another provider on your behalf.
7. Cookies, Analytics, and Advertising Technologies
The Site uses cookies and similar technologies. Cookies are small text files placed on your device that allow a website to recognise your browser and remember certain information.
We use the following categories:
- Strictly necessary cookies, which enable core functions such as page navigation, form submission, and security. These cannot be disabled through our consent tool because the Site cannot function correctly without them.
- Analytics cookies, which help us understand how visitors find and use the Site so that we can improve it. We may use Google Analytics for this purpose.
- Advertising and conversion-measurement cookies, which allow us to measure the performance of our advertising and to understand which campaigns and search terms generate enquiries. We may use Google Ads conversion tracking and remarketing tags for this purpose.
- Call-tracking technology, which may display a dynamically assigned telephone number so that we can attribute an inbound call to the advertisement or page that generated it.
You can control cookies through your browser settings, including blocking or deleting them. Blocking strictly necessary cookies may prevent parts of the Site from working. You can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on, and you can manage Google advertising personalisation through Google’s Ads Settings. Industry opt-out tools are also available through the Network Advertising Initiative and the Digital Advertising Alliance.
Our Site honours the Global Privacy Control signal where your browser transmits it. Because there is no industry-wide standard for “Do Not Track” browser signals, we do not currently respond to Do Not Track headers.
8. Telephone Communications, Recording, and Consent
Maryland is an all-party consent jurisdiction for the recording of telephone calls. Where we monitor or record a call, we will disclose that fact at the outset and obtain the consent of all parties before recording begins. Recordings, where made, are used for quality assurance, training, accuracy of work records, and dispute resolution, and are retained in accordance with Section 10.
Where you provide your telephone number through a form on the Site or during a call, you agree that we may contact you at that number about your enquiry or engagement. Separately, and only where you have given express written consent, we may contact you by autodialled or prerecorded call or by text message for marketing purposes. Consent to marketing contact is never a condition of purchasing any service. Message and data rates may apply.
You may withdraw consent to marketing contact at any time by replying STOP to a text message, telling our representative during a call, or emailing support@geniusanswer.online. We will action opt-out requests promptly. We may still contact you where necessary about an active engagement, a transaction, or a legal or safety matter.
We do not make unsolicited outbound calls to consumers, and we do not purchase or use cold-call lists.
9. Data Security
We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorised access, disclosure, alteration, and destruction. These include encryption of the Site in transit using TLS, access controls limiting personal information to personnel who need it, credential management requirements, and confidentiality obligations on our staff and contractors.
No method of transmission or storage is completely secure. While we work to protect your information, we cannot guarantee absolute security, and you send information to us at your own risk. If we become aware of a security incident affecting your personal information, we will notify you and any relevant regulator where required by applicable law and within the timescales it prescribes.
10. Data Retention
We keep personal information only for as long as we need it for the purposes described in this policy, and then delete it or irreversibly anonymise it. Our general retention practice is as follows:
- Enquiries that do not lead to an engagement: up to 24 months from the last contact, so that we can respond if you return to us.
- Engagement and work records: for the duration of the engagement and for up to 7 years afterwards, to meet accounting, tax, warranty, and limitation-period requirements.
- Invoices, receipts, and financial records: for the period required by applicable tax and accounting law, generally 7 years.
- Call recordings, where made: up to 12 months, unless retained longer for an active dispute, claim, or legal obligation.
- Diagnostic files, logs, and material accessed during a service engagement: deleted or returned within 30 days of completion of the engagement unless you ask us to retain it or we are legally required to.
- Cookie and analytics data: in line with the retention period set by the relevant provider, typically no more than 26 months.
- Recruitment applications: up to 12 months from the date of application unless you consent to a longer period.
Where we are required to retain information for longer to comply with a legal obligation or to defend a legal claim, we will retain only what is necessary for that purpose.
11. Your Privacy Rights
11.1 Rights available to residents of US states with comprehensive privacy laws
If you are a resident of California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, or another state with a comprehensive consumer privacy statute, you may have the right to:
- Know and access the categories and specific pieces of personal information we have collected about you, the sources of that information, our purposes for collecting it, and the categories of third parties to whom we disclose it.
- Correct inaccurate personal information we hold about you.
- Delete personal information we have collected from you, subject to statutory exceptions.
- Obtain a portable copy of the personal information you provided to us.
- Opt out of the sale of personal information, of sharing for cross-context behavioural advertising, and of targeted advertising. As stated in Section 6, we do not sell personal information; you may nonetheless opt out of advertising cookies as described in Section 7.
- Limit the use and disclosure of sensitive personal information, to the extent we hold any.
- Be free from unlawful discrimination for exercising any of these rights. We will not deny you services, charge you a different price, or provide a different level of quality because you exercised a privacy right.
California residents may also request the categories of personal information we disclosed for a business purpose in the preceding 12 months. Where permitted by law, an authorised agent may submit a request on your behalf; we will require written proof of authorisation and may require you to verify your identity directly.
11.2 Rights available under the GDPR and UK GDPR
If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have the rights of access, rectification, erasure, restriction of processing, data portability, and objection to processing based on legitimate interests or carried out for direct marketing purposes, together with the right to withdraw consent and the right to lodge a complaint with your supervisory authority.
11.3 How to exercise your rights
To exercise any right, email support@geniusanswer.online with the subject line “Privacy Request,” or write to us at 5100 Liberty Grove Dr, Burtonsville, MD 20866, USA, or telephone (866) 483-4006. Please tell us which right you wish to exercise and provide enough information for us to locate your records and verify your identity. We will acknowledge your request promptly and respond within 45 days for US state-law requests, extendable by a further 45 days where reasonably necessary and with notice to you, and within one month for GDPR requests, extendable by two further months for complex requests. There is no fee for exercising your rights unless your request is manifestly unfounded or excessive.
If we decline your request in whole or in part, we will explain why and tell you how to appeal. To appeal a decision, reply to our response with the subject line “Privacy Appeal.” We will inform you of the outcome of the appeal within 60 days, and where your appeal is denied you may contact your state Attorney General.
12. Children’s Privacy
The Site and our services are intended for adults and, where applicable, for businesses. We do not knowingly collect personal information from children under 13, and we do not knowingly sell or share the personal information of anyone under 16. If you believe a child has provided us with personal information, contact us at support@geniusanswer.online and we will delete it promptly.
13. Third-Party Links and Content
The Site may link to third-party websites, tools, or resources, including manufacturer support pages and software vendor documentation. We provide these links for convenience and information only. We do not control those third parties, are not responsible for their content or privacy practices, and encourage you to read their privacy policies before providing them with information.
14. International Transfers
We are established in the United States and our systems and service providers are located primarily in the United States. If you access the Site or contact us from outside the United States, your personal information will be transferred to and processed in the United States, where data protection law may differ from that of your jurisdiction. Where we transfer personal information from the European Economic Area, the United Kingdom, or Switzerland, we rely on appropriate safeguards such as the European Commission’s Standard Contractual Clauses together with any additional measures required.
15. Changes to This Privacy Policy
We may update this Privacy Policy to reflect changes in our practices, technology, or legal obligations. When we do, we will revise the “Last updated” date at the top of this page. If we make a material change, we will provide prominent notice on the Site and, where required by law, obtain your consent. We encourage you to review this page periodically.
